The use of this Web Site is subject to a legal and implied agreement between the purchaser and Pegasus Screen Printed Products Group Incorporated, a California Corporation, DBA Pegasus Products Group. GENERAL TERMS OF USE
RIGHT TO USE INTELLECTUAL PROPERTY
When you submit a design to Pegasus Products Group, you warrant that you are the legal owner or licensee of the design and have complete rights to use or change the design in any way consistent with your instructions to Pegasus Products Group. You further agree that the use of the design does not infringe upon the rights of any other entity. These may include but are not limited to: copyrights and/or trademarks; contract rights; moral rights; which would prevent Pegasus Products Group from legally reproducing the design you have caused to be submitted. At your sole expense, you agree to defend Pegasus Products Group from any action which may result from the use of any design which you have caused to be submitted for reproduction.
TERMS OF SALE
Unless credit terms have been previously arranged, payment for orders will be by credit card.
When a product displayed on this web site is out of stock or discontinued we will attempt to substitute with a similar product. From time to time product information on this web site may not be completely accurate. Products shown on this web site may become unavailable. Product colors, sizes, and prices may change without prior notice to users of this web site.
Whenever possible, we will ship UPS ground unless another form of transportation is requested by our customer. For time sensitive shipments, alternative transportation may be more appropriate. ALL SHIPMENTS ARE FOB PEGASUS and title passes to the customer upon receipt of shipment by a third party carrier. Loss or damage to product during shipment by a third party carrier is the customers responsibility. If you wish additional insurance beyond the tariff limits set by a carrier, please request in writing that this insurance be purchased on your behalf. Pegasus Products will increase the shipping charges to reflect the cost of the additional insurance.
WE DO NOT SHIP ORDERS ACCEPTED BY OUR SHOPPING CART TO ADDRESSES OUTSIDE THE UNITED STATES. SHIPPING CHARGES CALCULATED BY THE SHOPPING CART ARE FOR UPS GROUND SHIPMENTS WITHIN THE CONTINENTAL UNITED STATES. ALTERNATIVE SHIPPING IS AVAILABLE. PLEASE CALL 1-800-965-2580 WITH YOUR REQUEST FOR ALTERNATE SHIPPING.
IN THE CASE OF A PRICE CHANGE FOR SHOPPING CART MERCHANDISE, WE WILL NOT CHARGE MORE THAN SHOPPING CART PRICES, UNLESS THE CUSTOMER AGREES TO THE INCREASE PRIOR TO SHIPPING.
PRICES FOR SCREEN PRINTED AND EMBROIDERED MERCHANDISE ARE GUIDELINES ONLY. PEGASUS PRODUCTS GROUP WILL PROVIDE ESTIMATED PRICING BASED UPON ACCEPTANCE OF THE INDIVIDUAL DESIGN TO BE REPRODUCED.
The purchaser is solely responsible for all shipping, handling, insurance, taxes, duties, and import/export charges associated with a shipment. We charge and report Sales Tax on all merchandise sold to customers within the state of California. You may provide us with a California Sales Tax Exemption Certificate if you wish to accept responsibility for California Sales Tax. If you live outside California, you are solely responsible for remitting applicable sales or use taxes to your local taxing authority.
We will accept a return of non embroidered/screen printed merchandise sold on our web shopping cart if the merchandise is returned undamaged, within 10 days of receipt by customer. We will credit a customers credit card for undamaged merchandise less shipping charges upon receipt of merchandise at Pegasus. If a customer wishes to return merchandise, please call 1-800-965-2580 for authorization and address. Shipping charges for returned merchandise are the responsibility of the purchaser.
EMBROIDERED OR SCREEN PRINTED MERCHANDISE IS NOT RETURNABLE.
Pegasus Products Group liability is limited to the transfer of undamaged products to our customers carrier. We are not responsible for lost profits, business, or any other damages unless we agree to be specifically bound in a separate written agreement.
